1) Scope of application

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Nordholz GmbH (hereinafter referred to as "Seller") shall apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter referred to as "Customer") with the Seller with regard to the goods presented by the Seller in its online store. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

2) Conclusion of contract in the online store, telephone, e-mail, showroom

2.1 The Seller offers its products without obligation via the online offer. Before placing the order, you will again be shown all the data of the order, including a possibly different shipping address. There you can also change the order again if necessary, print or cancel.

2.2 By clicking the button "Order with obligation to pay" or "Buy" you place a binding order for the goods contained in the shopping cart. The execution of this order causes the knowledge and explicit acceptance of the terms and conditions, the privacy policy and the right of withdrawal on the part of the buyer.

2.3 The confirmation of the receipt of the order follows immediately after sending the order and does not yet constitute an acceptance of the contract. We can accept your order by sending an order confirmation by e-mail within three working days.

2.4 We store the text of the contract and send you the order data by e-mail. For security reasons, your order data is no longer accessible via the Internet.

2.5 For orders by telephone the regulations mentioned under point 2 apply accordingly, but with the following changes: The information provided verbally by the customer is binding and becomes part of the contract upon confirmation by the provider as defined in point 2.3. These GTC also apply to orders placed by telephone and are brought to the attention of the buyer (reference to the online store). The Provider may also attach them to the declaration of acceptance referred to in Punt 2.3.

2.6 The Purchaser may also place the order in person in the Provider's stores. The order is recorded by the Provider's employees. In this case, the contract is also concluded by the declaration referred to in § 4c. Please note that in this case you have no right of withdrawal.

2.7 For the conclusion of the contract in all cases (point 2 and 3) both the German and the Italian language is available.

3) Right of withdrawal

3.1 Consumers are generally entitled to a right of withdrawal.

3.2 More detailed information on the right of withdrawal can be found in the seller's cancellation policy.

4) Prices and terms of payment

4.1 Unless otherwise stated in the Seller's product description, the prices quoted are total prices which include the statutory value added tax. Any additional delivery and shipping costs will be indicated separately in the respective product description.

4.2 The payment option(s) will be communicated to the Customer in the Seller's online store.

4.3 If prepayment by bank transfer is agreed, payment shall be due immediately after conclusion of the contract, unless the parties have agreed on a later due date.

4.4 If payment is made by means of a payment method offered by PayPal, the payment shall be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal Terms of Use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - subject to the Terms and Conditions for Payments without a PayPal Account, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

5) Delivery and shipping conditions

5.1 The delivery of goods is made by shipping to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the Seller's order processing shall be decisive.

5.2 If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery or if the customer was temporarily prevented from accepting the offered service, unless the seller had given the customer reasonable advance notice of the service. Furthermore, this does not apply with regard to the costs for the Hinsendung if the customer effectively exercises his right of withdrawal. In the case of effective exercise of the right of revocation by the customer, the provision made in this regard in the seller's revocation instructions shall apply to the return costs.

5.3 In the event of self-collection, the Seller shall first inform the Customer by e-mail that the goods ordered by him are ready for collection. After receipt of this e-mail, the customer can pick up the goods at the seller's headquarters after consultation with the seller. In this case, no shipping costs will be charged.

6) Retention of title

If the Seller makes advance performance, he shall retain title to the delivered goods until the purchase price owed has been paid in full.

7) Liability for defects (warranty)

7.1 If the purchased item is defective, the provisions of the statutory liability for defects shall apply.

7.2 The Customer is requested to complain about delivered goods with obvious transport damage to the delivery agent and to inform the Seller thereof. If the customer fails to do so, this shall have no effect on his statutory or contractual claims for defects.

8) Material properties, pattern, packing unit

8.1 Wood is a natural product, so the grain and color are not always uniform. The images in our online offer may also differ visually from the delivered goods. This also applies to any samples previously sent or displayed in the retail stores of the supplier. After installation, parquet may change its color, especially due to strong light irradiation or mechanical stress.

8.2 In the case of repeat orders or additional deliveries, a color deviation from the original order is very likely. Therefore, please order an excess quantity of about five to ten percent directly with the first order!

8.3 When ordering, please be sure to note the packaging unit (PU), which can vary depending on the product and is usually not "round" square meters (for example, 2.888 m²). The VPE will be displayed together with the price. Minimum order quantity is usually one packaging unit. For a better overview, we usually show you the price per square meter first so that our ordering system in the store can calculate the possible quantity and the price to be paid for it based on your wishes.

8.4 We offer you the possibility to check the goods in advance on the basis of samples. The samples are usually free of charge for the buyer (only shipping costs will be charged), for details please refer to the information provided during the ordering process.

9) Alternative Dispute Resolution

9.1 The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr.

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

9.2 The Seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
